Newly Unveiled Model Clause！

On March 31th, the upgraded version of China International Commercial Court of the Supreme People's Court of PRC (hereinafter referred to as "CICC") "one-stop" diversified international commercial dispute resolution platform (hereinafter referred to as the “Platform”) was officially launched. The Platform has 4 functional modules including mediation services, arbitration services, litigation services and auxiliary services (neutral evaluation and case scheduling), effectively promoting the connection among neutral evaluation, mediation, arbitration and litigation procedures (for details, see: https://cicc.court.gov.cn/pc).

Under the guidance of Coordination and Guidance Office for CICC, Shanghai Commercial Mediation Center (hereinafter referred to as "SCMC") has also updated the model dispute resolution clause simultaneously for domestic and foreign commercial entities to choose.

The model clause is  hereby launched as follows:

(1) For a dispute arising out of cross-border commercial activities, all parties shall agree to resolve the dispute through mediation at SCMC before commencement of legal proceedings.

(2) For an international commercial dispute subject to the scope of cases stipulated in Article 2 of the Provisions of the Supreme People’s Court on Several Issues Regarding the Establishment of International Commercial Court, where no settlement reached during the mediation at SCMC, all parties agree to file a lawsuit to the International Commercial Court of the Supreme People’s Court through the Platform.
